PROCEDURE FOR GRANT OF CINEMATOGRAPH LICENCE UNDER THE PROVISIONS OF THE CINEMATOGRAPH ACT AND RULES.

 
Who is eligible

Any person not below the age of twenty years

Any company or firm or association of individuals whether incorporated or not shall be entitled to obtain or hold any permission or licence under Rule-4 of the A.P. Cinemas (Regulation), Rules, 1970:

For Multiplex theatres where there are three or more screens with shopping malls and food joints, before following the procedures mentioned below, the applicant should submit application

 

for grant of N.O.C. from the traffic point of view which has to be submitted by him to G.H.M.C.

NOC from Director General, Fire & Emergency Services Department for taking building permission as per Multiplex Rules, 2007.

What is the procedure:
Application for issue of “No Objection Certificate” for constructing Cinema Building.
Application should be in Form-A-1 and accompanied by the following documents:
A site plan drawn on a separate sheet to a scale of not less than 1 Cm to 500 Cms. Showing...

The position of the site in relation to any adjacent premises and to the public through fare upon which it abuts and ;

The surrounding roads and buildings like schools, hospitals, places of worship and the like, which exist up to a distance of 182 Mtrs. of the site.

Necessary records or certified copies thereof relating to his ownership and possession of the site if he is himself the owner thereof or those relating to his lawful possession thereof if he is not the owner;

The treasury receipt relating to the payment of fees prescribed in Rule-16;
Five additional copies of application and site plan and other papers mentioned in clauses (a) and (b) of this sub-rule.
   
Grant of “No Objection Certificate” for construction of cinema theatre under Rule-8 B of A.P. Cinemas (Regulation) Rules, 1970.

Within (15) days of receipt of any application for grant of “No Objection Certificate” the Licensing Authority shall:-

If the application is not in accordance with the rules, return the same to the applicant for re-submission with a period of sixty days failing which the application shall be treated as rejected and fresh application shall be made.

The Chief Executive Officer of Land Authority (in city the Commissioner, (MCH)
The Director of Town Planning in case of areas covered by Town Planning
Scheme.
The Health Officer (in city the Chief Medical Officer, (MCH)
The Officer not below the rank of Asst.Div. Fire Officer
Police Authorities (in city DCsP L&O & Traffic)
Hyderabad Metropolitan Development Authority

On receipt of the reports from the above Departments if the Licensing Authority is satisfied that the other requirements of these rules are fulfilled and that the applicant is in lawful possession of the site he shall within (15) days from the date of receipt of the said reports grant “NOC” applied for, either absolutely or subject to such condition as it thinks fit to impose:

Provided that if the Licensing Authority is satisfied that the provisions of these rules have not been fulfilled, he may refuse to grant “NOC” applied for.

The “No Objection Certificate” shall be granted within (45) days of the receipt of the application.
 

The N.O.C for construction of theatre shall not be granted on the sites which are within 182 Mtrs. of Schools, Colleges, Hospitals and places of worship.

If the licensing authority fails to send reply to the applicant either granting or rejecting the NOC applied for within the period of 45 days, the NOC is deemed to have been granted provided, the proposal is in conformity with the Act and Rules made there under.

Application for grant of permission to construct Cinema building under Rule-9(A)

          Application should be submitted in Form A-1 with following documents

Complete plans, elevations and sections, of the premises and of all erections or buildings thereon drawn correctly to a scale of 1 Cm. to 100 Cms. According to the specifications in Appendices I, II, III and IV and showing the position of the electrical machinery and Cinematograph Apparatus along with writing diagram which conforms as far as may be to the model writing diagram in Appendix.VII.

Such particulars as top the power, machinery, Plant or premises required.

The treasury receipt relating to the payment of fees prescribed in Rule 16
Four additional copies of the application accompanied by copies of plans and other papers mentioned in Clauses (a) and (b) of this sub-rule.(e) Any other plans, sections, elevations, designs, details, structural calculations and other particulars of the proposed or existing buildings and erections which the licensing authority in his discretion may consider necessary for the proper scrutiny of the application and grant of licence.
Drawings and data submitted should show compliance with applicable clauses of Exit, Fire prevention and safety measures as prescribed in Common Buildings Rules, 2006
Application for grant of permission to construct Cinema building under Rule-9(B)

         Within 15 days of receipt of any application for grant of permission, the Licensing Authority shall

If the application is not in accordance with the rules, return the same to the applicant for re-submission within a period of (60) days failing which, the application shall be treated as rejected and fresh application shall be made.
If the application is in order, forward a copy each of the application together within its enclosures to the Elec. Inspector, Asst. Divisional Fire Officer, the concerned Executive Engineer (R&B), and the Health Officer of the local authority asking for their report within 30 days.
On receipt of the report referred to in clause (b), if the licensing authority is satisfied that the other requirements of these rules are fulfilled, he shall within 15 days from the date of receipt of the said reports, grant the permission applied for either absolutely or subject to such conditions as it thinks to impose.
 
Provided that if the Licensing Authority is satisfied that the provisions of these rules have not been fulfilled, he may refuse to grant the permission applied for and communicate to the applicant the reasons for such refusal.
Provided further that if orders either granting or rejecting the permission applied for are not passed and communicated to the applicant within 90 days from the date of receipt of the application, it shall be deemed that the permission applied for has been granted.
Provided further that the application for construction or re-construction of the Cinema theatre should be inconformity with not only the Act and the rules but also with the provisions envisaged under Sec.6 of the Act and Rules and Byelaws etc. made there under.
Application for grant of Form-B Cinematography Licence under Rule–11(A)
        Application should be in Form A-II which should be accompanied with the documents as mentioned in the Rules:
 
Grant of Form-B Licence to Cinema Building under Rule – 11 (B)

Within (15) days of such application, the Licensing Authority shall

 

If the application is no in accordance with the Rules, dispose it off in accordance with clause (a) of Sub-rule 9 (B).

If the application is in order, forward a copy of the application together with its enclosures to the Electrical Inspector and Executive Engineer (R&B), Director General, Fire Services asking for their reports and Certificates within (30) days

On receipt of reports and certificates, if the Licensing Authority is satisfied that the applicant is in lawful possession of the site, building and equipment, he shall, within (10) days from the receipt of above reports and certificates grant a license in Form-B with or without adding additional conditions thereto as he made deem fit in the interest of the health and safety of the public.

While granting Form-B licence the Licensing Authority shall also fix, the maximum rates of admission to the different classes.

Application for renewal of licence under Rule – 12 (A)
       Form-A-II as laid down in the A.P. Cinemas (Regulation), Rules, 1970.
 
Transfer of Form-B Cinematography Licence as per Rule – 12 A (b) of the A.P. Cinema Regulation Rules, 1970.
    The following documents are required

Application in Form H requesting for transfer of Form–B Cinematograph licence.

Letter of consent in writing from the original licensee for transfer of possession of site, building and equipment to the effect that he has not objection to the license being transferred in the name of the transferee and an affidavit should be executed to this effect.

Lease deed

N.O.C. from A.P. Film and TV Development Corporation

Rs.300/- for each screen towards transfer fee
